The EU Commission has approved Temu’s action plan to remedy violations of the Digital Services Act (DSA) related to the risk assessment obligations set forth in the law, with particular reference to the distribution of illegal products on its marketplace. The Chinese company will have four months to implement the measures, which include checks on moderation systems, recommendation algorithms, and ad manipulation. The plan will undergo an external and independent audit. Brussels will monitor its implementation after imposing a €200 million fine on Temu in May 2026. “The approved measures represent an important step toward strengthening online consumer protection, helping to ensure that the risk associated with the presence of illegal products on Temu’s marketplace is properly assessed,” the Commission noted in a statement. In particular, the e-commerce giant has committed to conducting a platform-specific risk analysis and to using reliable metrics to assess the effectiveness of the mitigation measures put in place to reduce the risk of illegal content spreading. Temu will also have to assess the limitations of its content moderation and analyze whether—and how—its recommendation systems and other algorithmic systems may facilitate the spread of illegal products. The company will examine the role of intentional manipulation of the service and the possibility of rapid, large-scale dissemination of illegal content, including by sellers who exploit Temu’s features to post potentially illegal listings. According to the Board for Digital Services, which was consulted on these measures, the plan lacks sufficient detail to determine whether it comprehensively addresses the violation identified. The Commission has taken the Board’s opinion into account and has clarified the key requirements that Temu must address when implementing the action plan. The company will submit the relevant audit report to the Commission within four months of implementing the measures set out in the action plan. The Commission will closely monitor the implementation of the action plan, paying particular attention to the aspects that the Board deemed insufficiently clarified and for which further information is required. In July 2025, the Commission issued preliminary findings against Temu, and then confirmed those findings in May 2026, imposing a fine of 200 million euros on the company for failing to comply with its risk assessment obligations.
